Wrong diagnose of medicine

We went to a doctor last week and they advised my nephew to take this particular medicine. but instead of curing his sickness, it became worse. We are planning to file a case against the doctor since his life was threatened due to wrong diagnosis of medicine. I am aware that he might lose his job if we file a case against him but my nephew's life was put in danger.

There are two choices in this situation. First is to either file a lawsuit regarding the misdiagnosis committed by the doctor. But based on statistics, there is a small chance of winning the case. Second is asking for a compensation because since a person's life was put at stake, it is now part of his right to ask for compensation. The latter would be better because you will avoid spending more money for the lawyer and all.
